Standardized Operating Procedures
Tenant Management Solutions LLC (the "Broker"), a licensed New York real estate broker at 99 Oak Street #1A, Binghamton, NY 13905, adopts these Standardized Operating Procedures under New York Real Property Law Section 442-h. They state the prerequisites prospective homebuyers and renters must meet before receiving services.
The Broker and every licensee affiliated with the Broker apply these procedures to every prospective client, every time, without exception. A licensee who fails to follow them is subject to discipline.
Prospective homebuyers
Identification: Required. Every prospective homebuyer must show a valid government-issued photo ID before receiving services, including in-person and live virtual showings.
Written agreement: Required. Exclusive agreement: Not required. A written non-exclusive agreement is required before touring; an exclusive agreement is not required.
Mortgage pre-approval or proof of funds: Not required. The Broker does not require pre-approval or proof of funds before providing services.
A seller may require pre-approval, proof of funds or other information before showing a property or accepting an offer. When a seller does, the Broker will tell the prospective homebuyer before arranging the showing.
Prospective renters
Identification: Required. Every prospective renter must show a valid government-issued photo ID before receiving services, including in-person and live virtual showings.
Exclusive broker agreement: Not required. Prospective renters may receive services without signing an exclusive agreement.
Pre-qualification: Required for in-person showings. Not required for virtual tours. Before an in-person showing, every prospective renter completes a short pre-qualification: desired move-in date, number of occupants, and whether total household income meets the property's published income requirement. Housing vouchers and other lawful sources of income count toward that requirement. No fee, credit check or documents are required at this stage. Virtual tours are available without pre-qualification. A renter who cannot use a virtual tour because of a disability may request a reasonable accommodation.
When a prospective renter applies for a unit, the application is evaluated under the property owner's written screening criteria, applied the same way to every applicant. Lawful source of income, including Section 8 and other housing vouchers, is accepted on equal terms with other income. Any application or screening fee will not exceed the amount New York law allows.
Fair housing and availability
The Broker complies with all federal, state and local fair housing laws. These procedures apply equally to everyone, regardless of any protected characteristic. The NYS Housing and Anti-Discrimination Notice is posted at the Broker's office and on its website.
These procedures are posted on the Broker's website and are available at the Broker's office on request. If they change, the Broker will date stamp and notarize the new version, keep the prior version on file, and post the new version at the office and online within 30 days.
